Faster debt collection for utility bills proposed in Kazakhstan

Kazakhstan's Ministry of Justice plans to develop a bylaw regulating the collection of utility payment debts through notaries. The initiative concerns cases where debts are collected using notarial writs of execution.

According to Member of Parliament Yekaterina Smyshlyayeva, representatives of condominium associations (OSI) and housing cooperatives (KSK) from different regions have raised concerns about difficulties in working with notaries when collecting debts from apartment building residents.

The main issue is that not all notaries are willing to handle utility debt collection through notarial writs. In practice, only one or two notaries in many cities perform this work, resulting in a heavy workload being concentrated on a small number of specialists.

Representatives of housing cooperatives submit a large number of debt collection requests to notaries. In some cases, this involves 500 or more applications at the same time. At the same time, regional notarial chambers, which oversee notaries, state that issuing such a large number of notarial writs at once is unacceptable.

As a result, the processing of applications is delayed. If the proposed changes are adopted, the debt collection process could become faster, allowing payments from debtors to reach organizations managing residential buildings more quickly.
